Independent Homicide Inquiries listed by Date of Publication

They are to be studied, not to improve the level of anticipation and prevention of future such events, that seems too difficult to do in individual situations,
but also because they disclose the state of delivery in practice of the secondary specialist mental health service at the time of the tragedy,
a disclosure generally hidden from the public,
largely revealing deficiences in provision and faults in the working practices at the time of the - so-called mental health 'Teams'.

But chiefly, how and when to intervene, in someone's liberty of action when they are showing signs of illness , and using what authority to do that.

Inquiries after Homicide are concerned to examine the competence of a system of care
that was present in the background to a killing, as judged against the ordinary standards at the time
The majority of examinations of this kind show a failure of care to reach the patient
Supposing the tragedy that brought about this examination of the service given, had not occurred,
it would still remain that the care system was not as it should have been at that time, in that palce.
It is that - rather than the media headlines. which are truthful but stigmatic;
or truthful excuses, that events such as this are not predictable - that should be the matter for public concern, shame, and repair.
The public should require a better regard for the plight of those, unable to judge the behaviour of their own illness, unable to by their illness to take care of themselves, and therefore of necessity, relying upon other agents to take that care into their hands.

The biggest issue is the dificult judgment on how to obtain control in shifting circumstances; how to find the power to use coercion.


The list of Reports after Homicide is laggardly, awaiting a necessary updating when Strategic Health Authorities - especially NHS North West and NHS South West [ they are on the job ! ] , get around to publishing am updated link on their websites, as they are expected to do by DoH.

The problem is that the old links to publications on a previous website, closing that down, they were not immediataely transferred to SHA ownership, then were loat.

It means some of my linking to the original website Reports are now lost and awaiting reprieze by the latest Authorities.

Criteria
An independent investigation should be undertaken in the following circumstances:
1. when a homicide has been committed by a person who is or has been under the care, i.e. subject to a regular or enhanced care programme approach, of specialist mental health services in the six months prior to the event.
2. when it is necessary to comply with the State’s obligations under Article 2 of the European Convention on Human Rights. Whenever a State Article 2 of the European Convention on Human Rights. Whenever a State agent is, or may be, responsible for a death, there is an obligation on the State to carry out an effective investigation.
This means that the investigation should be independent, reasonably prompt, provide a sufficient element of public scrutiny and involve the next of kin to an appropriate extent.

3. where the SHA determines that an adverse event warrants independent investigation, for example if there is concern that an event may represent significant systemic service failure, such as a cluster of suicides.

Initial management review.
In all adverse events, a rapid (usually within 72 hours) internal service management review should take place. This should cover any necessary immediate action with respect to staff, safeguarding notes or equipment as evidence, changes in policies and procedures, changes to ensure safety (such as ligature point removal), communication with relevant individuals and organisations and initial contact with carers and families.

Internal NHS Mental Health Trust investigation The management review will usually be followed by an internal Trust-led investigation, using an approach such as root cause analysis (RCA). This investigation should establish a clear chronology of events leading up to the incident; determine any underlying causes and whether action needs to be taken with respect to policies, procedures, environment or staff. The chronology, statements and report of any internal investigation should be made available to the independent investigation team. In situations where it is clear at the time of the adverse event that an independent investigation will be commissioned by the SHA then discussion and agreement between the Trust and the SHA should take place to establish the nature and scope of the internal Trust investigation to ensure that any duplication of investigation is avoided.

Everyone whose rights and freedoms as set forth in [the] Convention are violated shall have an effective remedy before a national authority notwithstanding that the violation has been committed by persons acting in an official capacity.

DPD = PD with criminal record ... and I suppose A N Other.

Assessments of some of the symptoms and behaviour problems of long-term psychiatric patients living in the community were obtained independently from clinical interviews with such patients, and from interviews with day staff, residential staff and families caring for them. In general, interviews with residential staff and family members revealed much higher levels of symptoms and behaviour problems than either of the other two interviews.
These findings have implications for research and clinical practice including the fact that adequate assessments should include the testimony of family or residential staff

The Authority commissioning the old Mandatory external inquiries now changes , and in the overlap to the new arrangements, the Inquiry system is changing also, without the relatively predictable internal consistency of the old one.
That sort of Inquiry had also been found wanting by the European Court, when one Inquiry [ edwards]had not made sufficent allowance in its practice to give the family affected 'the rights of victims' to an explanation full enough to enable them to decide what further steps thay might take.

The usual 'Court' for this would be an inquest - with new guidelines to Coroners to be sure family 'victims' got their say. In convicted Homicide there will not be a Coroner Inquest.

The old mandatory external Inquiry , which had come to follow some sort of standard process, is now being abandoned, and each relevant Strategic Health Authority, together with the Primary Care Trust and the 'delivering' Care Trust implicated, are devising their own interpretation of what to do, generally saying they are following advice from the National Patient Safety Agency, as to how to apply a Root Cause Analysis procedure to the care and treatment given, and how that contributed to the final event.

The first one to hand is from london and was so hard to follow they asked Professor Burns form George's to comment which he did benignly and in a practical way - although getting the RCA out of the way by saying it was hard to follow !

How far back will they go ?

Some PCT's and SHA's are raising the issue of confidentiality and that they might not publish.

A quite awful Inquiry Report from an event in 1997 has just come to hand [ Bellis; Bidwell ] anorexic in content, and delivered six years late !!?? It quotes the National Confidential Enquiry as backing up giving up the mandatory external Inquiry Reports.
Will they point to inherited Resource constraints: overcrowded admission wards, high re-admission rates, high sickness rates , high locum and agency usage; using 'confidentiality' as an excuse for not seeking wider information about community behaviour, known to family and local people, and the police; finding some consultant psychiatrists somewhat detached, abrogating leadership

a North West legacy Review to be presented at the September 2009 Board meeting , reports thus

3.1.2 Forty two potential cases were identified, which were at different stages of investigation, reporting and publication.
Seven cases did not meet the criteria for independent investigation.
These incidents had been reported but further clarification confirmed that they were not homicides;
were outside the time-scales for eligibility;
or where there had been no involvement of specialist mental health services.

3.1.3Of the remaining thirty three cases,
twelve had been subject to full independent investigation and nineteen had been subject to an internal Trust investigation. Seven of these nineteen cases had been subject to a further degree of independent consideration
but did not amount to full independent investigation.
In the remaining two cases, the report was not available at the time of this project.

Cases not included in this project are being managed under the NHS North West independent investigations procedures.

3.4.2Review panels met eight times to examine the nine cases where a full independent investigation had not been carried out. The report(s) for each case were audited by the project team prior to the meeting. For each case the report(s), audit

3.4.4 It was unnecessary for the review panel to consider cases where a full independent investigation had already been completed. In these cases the project team audited each report and collated the conclusions and recommendations. There were twelve cases in total.

4.14.3In particular, the panels were concerned not to cause further distress to families of both victims and perpetrators by revisiting incidents that had taken place several years ago.
• The time, cost and service disruption from a series of independent investigations would be a significant demand on the services.
The interests of the families, service users and the public would be better served by ensuring that the identified lessons were fully implemented in practice.

5.2.2 It was agreed that each trust would be sent three reports: one with the recommendations from their individual cases, the second the recommendations arising from the key themes identified across the North West and the third an assessment of the quality of their investigation reports.
